Who are we: "the Company", "We", "Us" or "Our" refers to CHA DONG.

How we may contact you: If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.
Our contract with you
When you place an order with us, your order is classed as an offer which, if accepted by us, will result in a binding contract. Acceptance of your order will take place when we email you to accept it at which point a contract will come into existence between you and us. If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.
We will not be responsible for delays, damages, or issues with quality (flavour or condition) of any orders placed that are forwarded on from the shipping address given upon checkout.
Product description and substitution
Products and packaging may vary slightly from pictures. The images of products on our website are for illustrative purposes only.
Your right to make changes
If you wish to make a change to the product you have ordered, please contact us and we will let you know if the change is acceptable. If it is possible we will let you know about any changes to the price of your order, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
Delivery and pick up
Deliveries are made by Packfleet or another same day courier (London M25) or Parcelforce (outside of London) on a next day service.
It’s always best if someone is available to receive the delivery. If we are aware of a delay, we will attempt to contact you and minimise any disruption. You may also be contacted by the courier company directly.
The product will be your responsibility from the time we deliver the product to the address you have given us, or in accordance with the alternative delivery instruction you have provided. You own the product once we have accepted your order and received payment in full.
For pick up orders, your item will typically be available within 2 business days. We will contact you via email when your order is ready for collection. Your products will be held for 3 working days after the date of this email. It is your responsibility to collect your product within this time frame. Please contact us if you have any issues and we will try our best to accommodate any change of plans, however, we cannot guarantee this. As our products are perishable, no refunds will be provided for no-shows / non-collection within the specified timeframe.
In some circumstances, you may be able to contact the courier to arrange or alter delivery preferences. We will not be liable for the delay of or condition of your product should you choose to arrange or alter your delivery preferences directly with the courier.
We may delay the despatch of your products in the event of extreme weather conditions (i.e. below -5°C or above 28°C). You will be contacted to arrange an alternate delivery date in such circumstances.

Offer entitles you to one free bottle of Clementine Iced Tea valued at £10 for orders over £35 (total at final checkout). Clementine Iced Tea must be added to your cart for offer to apply.
If the offer had been intentionally / unintentionally applied to an order without a Clementine Iced Tea being added to the cart, we reserve the right to cancel the order or make necessary adjustments to your order to reflect the true value of your order.

Quality concerns
We take great pride in the quality and condition of our products, and it should reach you in the best possible condition. When you receive your order, please remove all external wrapping, check the products are undamaged, that the correct products have been supplied in the right quantities and place in the fridge if it is not to be consumed immediately. If you aren’t happy with what you find, please email us along with pictures to hello@chadong.co.uk. We will do our best to put it right.
Where an intermediary address is used, CHA DONG will not be responsible for delays, damages, or issues with quality (flavour or condition) of any orders placed that are forwarded on from the shipping address given upon checkout.
Your rights for any other items
It is your responsibility to make sure you order the products that you want. As these products are perishable, unless the product is damaged or incorrect, we will not be able to provide a refund or exchange. Please contact us, and if possible, email pictures to hello@chadong.co.uk. We will do our best to put it right.
Refunds (if applicable)
Once your return email, with pictures are received, we will send you an email to notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 14 days.
Late or missing refunds (if applicable)
It may take some time before your refund is officially posted. Please contact your bank to check refunds processing time.

Online resellers
Our online shop at chadong.co.uk and authorised sellers listed in the Stockist section of our website are the only authorised seller of CHA DONG products online.
Should an individual or business order from us and re-sell our products without our knowledge or consent, it is important to note that any purchases made from an unauthorised reseller will not be covered by our terms and conditions and we will not be responsible for lost items, unfulfilled orders, damages or issues with quality, such as flavour or condition.
Intellectual property rights
We are the owner or the licensee of all intellectual property rights in our website and social media platforms, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may not copy or reproduce part or all of the contents of the website in any form including, without limitation, its incorporation into or store in any other website, electronic retrieval system, publication or other work (whether hard copy, electronic or other) without our express permission.
Privacy
CHA DONG is the data controller for the purpose of the Data Protection Act 1998.
By preceding to use our website you consent that we may process the personal data (including sensitive personal data) that we collect from you in accordance with our privacy policy. In particular we will use information we hold about you for the purposes of fulfilling orders. Changes to the website
We may update our website and these terms and conditions from time to time, and may change the content at any time. We do not guarantee that our website, or any content on it, will be free from errors or omissions.
Governing law
These terms are governed by the laws of England and Wales. For the avoidance of doubt, if you live in Scotland, Northern Ireland or Wales, you can bring legal proceedings in respect of the products in either your local courts, or the English courts.
